1. Acceptance of terms
These Terms of Service ("Terms") govern access to and use of www.californiahousingprices.com and the services, features and content made available through it (together, the "Site"), operated by California Housing Prices (the "Operator", "we", "us" or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not access or use the Site. If you access the Site on behalf of an organization, you represent that you have authority to bind that organization, in which case "you" refers to that organization.
2. What the Site is; rankings and commentary are opinion
The Site publishes housing market data, guides to buying, selling and living in California, rankings and comparisons of places, and profiles of featured local real estate agents (together, "Site Content").
Rankings, ranking positions, "best" lists, ratings, comparisons and similar evaluative content are statements of opinion reflecting the Operator's editorial judgment applied to the data the Site names. They are not statements of verifiable fact, are not guarantees of any result, and are not endorsements of any place, property or professional. Inclusion on, prominence within, or omission from the Site does not indicate that any professional is or is not qualified, licensed or suitable for any particular purpose or transaction.
3. Methodology and editorial discretion
Each ranking on the Site states the data and method it uses. The Operator reserves the right, in its sole discretion and without notice, to select and change the criteria it considers, to weight those criteria as it deems appropriate, to apply editorial judgment beyond any stated criteria, and to add, remove, re-rank, revise or decline to publish any ranking, profile or other Site Content at any time. 4. Advertising, compensation and featured agents
Real estate agents pay the Operator to be featured on the Site. Each agent named on a page titled "Best Real Estate Agent", "Featured Local Agent" or similar, or labeled "Featured", is a paid partner of the Operator. These titles and labels denote a paid, promotional placement for that place. They are not a representation that the agent ranks highest among all agents in that place under any evaluation, and the Site does not compare featured agents with agents who are not featured.
Payment does not buy, change or influence the Site's market data, guides or rankings of places, and featured agents do not write or approve them. Compensation does not guarantee continued placement, and the Operator may remove a featured agent at any time.
5. Accuracy of the Site
The Operator makes no representation or warranty as to the accuracy, completeness, timeliness or reliability of the Site or any Site Content. Site Content is compiled from a variety of sources, which may include Redfin and Zillow research data, the US Census Bureau, Freddie Mac, government agencies, public records, licensing databases, third-party review platforms and information supplied by professionals, and portions of Site Content are assembled or drafted using automated and AI-assisted tools. Market figures describe the month stated next to them, may be revised by their sources after publication, and may not reflect current conditions. Laws, tax rates, program limits and fees change. The Operator has no obligation to monitor, refresh or update any Site Content, and no Site Content should be assumed to be current as of the date you view it.
The Site is provided free of charge, and your use of the Site and any reliance on Site Content is at your sole risk. Before relying on any figure or rule, or engaging any professional, independently verify it with the source named on the page, the relevant government office, and a licensed professional. Verify any agent's license with the California Department of Real Estate.
6. Third-party content and links
The Site displays, incorporates and links to content originating with third parties, including data published by Redfin, Zillow and government agencies, and agent profile information, photographs, reviews and websites ("Third-Party Content"). Third-Party Content is the responsibility of the person or entity that provided it. The Operator does not adopt or endorse Third-Party Content. Statements made by or attributed to a professional, including claims about experience, sales, credentials, awards or results, are that professional's alone. Links to third-party websites are provided for convenience only and do not imply endorsement or association.
7. Enquiries and introductions to agents
The Site lets you send an enquiry about buying or selling a home. When you send one, you ask us to pass your details to a featured local agent for the place you name, and you agree that the agent may contact you by phone, text message or email about your enquiry. You are under no obligation to work with that agent. Our Privacy Policy explains what we collect and who receives it.
8. No brokerage relationship
The Operator is not a real estate broker, agent or advisor; does not represent you or any other party; and is not a party to any engagement between you and any professional named on the Site. Any engagement, communication, negotiation or transaction between you and a professional is solely between you and that professional. To the fullest extent permitted by law, you release the Operator and its affiliates, officers, directors, employees and agents from claims arising out of or relating to your dealings with any professional, including that professional's acts, omissions, representations or services.
9. Fair housing
The Operator supports the federal Fair Housing Act and California's Fair Employment and Housing Act. Site Content does not describe who a place is suited to and does not steer anyone toward or away from any area. If you believe any content falls short of this, report it to privacy@californiahousingprices.com.
10. Errors and corrections
The Site may contain errors, inaccuracies or omissions, including in rankings, profiles, figures, guides and descriptions. The Operator may correct any error and change, update, annotate or remove any Site Content at any time without notice, but assumes no obligation to do so. If you believe a factual point on the Site (such as a figure, a tax rate, a license status or a contact detail) is wrong, report it to privacy@californiahousingprices.com with supporting documentation. The Operator decides, in its sole discretion, whether and how to correct, update, annotate or remove reported content. A correction is made for accuracy and goodwill and is not an admission of error, fault or liability. To the fullest extent permitted by law, the Operator has no liability for any error, inaccuracy or omission in Site Content, including for any period before it was corrected or removed.
11. Information disputes
If you dispute Site Content concerning you or your business, submit the dispute in writing to privacy@californiahousingprices.com, identifying the specific content and the basis for the dispute, with supporting documentation for any factual assertion. The Operator will consider properly submitted disputes in good faith but retains sole discretion over their resolution, consistent with Sections 3 and 10. Disputes about opinion content, including rankings and evaluative commentary, do not obligate the Operator to make any change.
12. No professional advice
Site Content is general information. It is not legal, tax, financial, insurance, appraisal or real estate brokerage advice, and it is not an appraisal or valuation of any property. You are solely responsible for decisions made in reliance on Site Content.
13. Use of the Site; automated access; citation
You agree to use the Site only for lawful purposes. You shall not interfere with or disrupt the Site or its infrastructure; attempt to gain unauthorized access to any system or data; transmit malicious code; impersonate the Operator or any other person; submit false enquiries or another person's details; or use the Site or Site Content to build or operate a competing directory, ranking or data service.
Automated access: the Operator permits good-faith indexing and retrieval of public Site pages by search engines and artificial intelligence systems, consistent with the Site's robots.txt file as in effect from time to time. All other automated collection, scraping or bulk downloading of Site Content is prohibited without the Operator's prior written consent.
Citation: the Operator grants a limited, revocable license to quote or cite Site rankings and brief excerpts of Site Content, with attribution to California Housing Prices and, where practicable, a link to the Site, provided the quotation is accurate and not misleading. This license does not permit republication of substantial portions of the Site, and it does not extend to data owned by third parties such as Redfin or Zillow, which remain subject to their owners' terms.
14. Intellectual property; limited license
The Site and Site Content, including text, graphics, data compilations, software, and the design, selection and arrangement of them, are owned by the Operator or its licensors and are protected by United States and international intellectual property laws. You are granted a limited, personal, non-exclusive, non-transferable license to access and view the Site for lawful purposes. Except as permitted in Section 13, no Site Content may be copied, reproduced, republished, distributed, sold or exploited for any commercial purpose without the Operator's prior written consent.
15. Submissions
If you submit corrections, dispute submissions, profile information or feedback to the Site or the Operator, you grant the Operator a non-exclusive, royalty-free, perpetual, transferable, sublicensable, worldwide license to use, reproduce, modify, publish and display that submission in connection with the Site, and you represent that you have the rights to grant this license and that the submission is accurate. This section does not apply to the personal details in an enquiry, which are handled under the Privacy Policy.
16. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND ALL SITE CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, TIMELINESS, AND UNINTERRUPTED OR ERROR-FREE OPERATION. NO ADVICE OR INFORMATION OBTAINED FROM THE OPERATOR OR THROUGH THE SITE CREATES ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.
17. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, THE OPERATOR AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, GOODWILL OR DATA, ARISING OUT OF OR RELATING TO THE SITE OR ANY SITE CONTENT, INCLUDING ANY ERROR, INACCURACY, OMISSION, RANKING, EVALUATIVE COMMENTARY OR THIRD-PARTY CONTENT, AND ANY RELIANCE ON THEM, UNDER ANY LEGAL THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. THE OPERATOR'S AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE SHALL NOT EXCEED THE GREATER OF THE AMOUNTS YOU PAID THE OPERATOR IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS ($100). SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS, IN WHICH CASE THEY APPLY TO THE MAXIMUM EXTENT PERMITTED.
18. Indemnification
You agree to defend, indemnify and hold harmless the Operator and its affiliates, officers, directors, employees and agents from claims, liabilities, damages, losses, costs and expenses (including reasonable attorneys' fees) arising out of or relating to your breach of these Terms, your submissions, your violation of any law or the rights of any third party, or your use of the Site or Site Content other than as authorized in these Terms.
19. Governing law; dispute resolution; jury waiver
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of New Hampshire, without regard to conflict-of-laws principles. Any dispute, claim or controversy arising out of or relating to these Terms or the Site, including any claim based on alleged tort, shall be resolved exclusively by binding arbitration administered by the American Arbitration Association under its applicable rules, held in Concord or Manchester, New Hampshire or, at your election, by video conference. Judgment on the award may be entered in any court of competent jurisdiction. Nothing in this section limits any right you have under the law of your state of residence that cannot be waived by agreement. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND THE OPERATOR EACH IRREVOCABLY WAIVE ANY RIGHT TO TRIAL BY JURY IN ANY PROCEEDING ARISING OUT OF OR RELATING TO THESE TERMS OR THE SITE.
20. Changes to these Terms
The Operator may revise these Terms at any time by posting the revised version on the Site with an updated effective date. Revisions take effect when posted, and your continued use of the Site after posting constitutes acceptance. The Operator may change, suspend or discontinue any part of the Site at any time without notice or liability.
21. General provisions
If any provision of these Terms is held invalid or unenforceable, it shall be modified to the minimum extent necessary or severed, and the remaining provisions remain in force. No waiver of any term is a further or continuing waiver. These Terms and the Privacy Policy are the entire agreement between you and the Operator concerning the Site. You may not assign your rights or obligations under these Terms without the Operator's consent; the Operator may assign these Terms without restriction. Nothing in these Terms confers rights on third parties, except that the Operator's affiliates are express third-party beneficiaries of Sections 6, 8, 17, 18 and 19. Sections 5 through 12 and 14 through 20 survive any termination of your use of the Site.
